JUDGE DISMISSES CASE AGAINST NAVARRE COMBAT VETERAN

A Navarre man's attempted murder case was dismissed after a judge ruled that Stand Your Ground laws applied in a November 2022 shooting. Navarre Attorney Keith Kilpatrick in August filed a Stand-Your-Ground Law motion to dismiss an attempted murder case the First Judicial Circuit State Attorney’s Office pursued against his client, Josh Huston, a 100% disabled Iraqi combat veteran. The shooting happened on Nov. 7, 2022, on Pine Ranch Drive. Santa Rosa County deputies arrested 47-year-old Joshua Huston for attempted murder in the shooting of 44-year-old Myrick Brock Hamilton. Court documents stated that Hamilton, who was trespassing, was behaving irrationally. Huston was armed due to recent theft at their home and he opened fire, after seeing a shiny metal object carried by Hamilton. One of the shots hit Hamilton in the arm. After investigating and consulting with the State Attorney's Office, the Santa Rosa County Sheriff's Office determined at the time that Stand Your Ground did not apply. Huston was released from jail a few days after his arrest on $100,000 bond. The Judge wrote in the new court documents filed yesterday QUOTE "The Court finds that the State has not met its burden and therefore [Huston's] Motion to Dismiss is Granted".
